Pedestrian recovers compensation after car mounts kerb in Holland

Irwin Mitchell has successfully recovered £1700 for a pedestrian, Mr H, after he was struck by a car in Holland.

Mr H was visiting his daughter in Schinveld, Holland, when he was involved in a road traffic accident. Mr H had been walking in the town centre when a car mounted the pavement and struck him from behind, throwing him into the air. 

Mr H sustained a fractured rib, back injuries and bruising and lacerations to the elbow. The accident ruined Mr H’s holiday and prevented him from helping his daughter move house, which had been the purpose of his visit.  Mr H was also unable to work for several weeks.

Once instructed, Irwin Mitchell submitted the claim to the driver’s insurers’ UK representatives. This made the claims process much simpler than dealing with the Dutch insurers direct. 

Under the relevant law Mr H’s claim had to be valued under Dutch law. Irwin Mitchell therefore obtained advice from an expert Dutch lawyer on the value of the claim. An amicable settlement was reached without the need to issue court proceedings, and Mr H received £1700 in compensation.
