Road Traffic Accident in Malaga, Spain

Irwin Mitchell acted for a passenger in a hire car who was attending a friend’s funeral in Spain. She was injured when the driver of the car in which she was travelling entered the wrong side of the road and collided "head-on" with an oncoming lorry.

Fortunately, the client’s injuries were not as serious as they could have been in the circumstances - she sustained a fracture of the right arm, in addition to soft tissue injuries to the pelvic region and right knee.

Irwin Mitchell pursued this claim in the English jurisdiction against the English driver and the Spanish insurers of the hire car.

Following extensive negotiations, the Defendants’ Representatives eventually admitted negligence on behalf of the Defendants. Despite the Defendants’ Representatives' initial refusal to enter into settlement negotiations, Irwin Mitchell was nevertheless successful in negotiating a suitable settlement figure of £22,000, shortly before the trial date was due to be scheduled.
