Compensation Recovered following Fall from Ski Lift

Irwin Mitchell acted on behalf of a client, Mr Bish, who was introduced to Irwin Mitchell, more particularly, Philip Banks, who was described by another solicitor as “a worthy adversary and one to whom she frequently lost cases to”.

Mr Bish had sustained severe injuries after falling almost thirty feet from a ski chair lift at the Kitzbuhel Ski Resort in Austria on Boxing Day 2002. Mr Bish fractured his spine in two places as a result of the fall. The ski lift operator had failed to notice that our client had not mounted the chair lift properly and did not attend to him accordingly. No action was taken by the operator to stop the lift either.

Not only was our client faced with the difficulty of providing criminal evidence against the employee of the ski lift company, but the added complications of attempting to resolve a civil claim for personal injury in a country where they did not speak the language, and whose legal complexities and proceedings were very different to that in the UK.

After years of litigation, Irwin Mitchell achieved a successful settlement from the Austrian ski lift company on behalf of Mr Bish, who said that “At all times we received a service which  was not only completely professional in its approach, but was also friendly, compassionate and sensitive to our needs.
